Last Friday, HJR 46 joined six other decriminalization bills, SJR 17 and SJR 18; each of which is attempting to roll out meaningful marijuana reform in the great State of Texas. If passed, HJR 46 would legalize and regulate the recreational sale and consumption of marijuana within the Lone Star State via a constitutional amendment.
Texas requires a two-thirds supermajority in both chambers of the Texas State Legislature to advance this type of proposed constitutional amendment to the ballot. Currently, residents of the border state face a $2,000 fine and 180 days in jail for getting caught with less than 2 ounces of marijuana.
Filed last week, HJR 46 seeks a “constitutional amendment directing the legislature to authorize and regulate the possession, cultivation, and sale of cannabis.”
Provided HJR 46 makes it through the arduous legislative process — Texas is one of sixteen states with a two-thirds majority requirement — the proposed constitutional amendment would be submitted to the voters on November 6, 2018.
